1. About DANESURE

DANESURE, Inc. (“DANESURE,” “we,” “our,” or “us”) is a licensed commercial insurance brokerage incorporated in Arizona:

As an independent broker, DANESURE represents you — the client — not any insurance carrier. We are compensated by carriers through commissions when policies are bound. We disclose commission arrangements upon request.

2. Acceptance of Terms

These Terms of Service (“Terms”) apply to all visitors and users of danesure.com and to any individual or business that engages DANESURE for brokerage services. By submitting a form, uploading documents, or requesting a quote or coverage review, you represent that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you do not agree, please do not use our website or services.

3. Nature of Our Services

DANESURE provides the following services:

• Coverage reviews: Analysis of your existing commercial insurance policies to identify potential errors, coverage gaps, rating errors, and cost savings opportunities
• Insurance quotes: Solicitation of quotes from multiple carriers on your behalf for commercial lines of insurance including general liability, workers compensation, commercial auto, property, umbrella, cyber, and professional liability
• Policy placement: Facilitating the binding of insurance coverage with licensed carriers through our carrier access agreements
• Ongoing service: Certificate of insurance issuance, policy review, renewals, and claims support for active clients

4. No Guarantee of Rates or Coverage

Any rate estimates, savings projections, or coverage comparisons presented on our website or in our communications are based on industry averages, publicly available data, or preliminary analysis. They are for illustrative purposes only and do not constitute a firm quote or guarantee of any specific premium, rate, or coverage availability.

Actual rates are determined by insurance carriers based on full underwriting information and are subject to change. Coverage is not bound until a policy is issued by a licensed carrier and all premium payments have been received.

DANESURE does not guarantee that any specific carrier will accept your submission, that coverage will be available at any particular price, or that your current policy contains errors or that savings will be realized.

5. Coverage Reviews and Audits

Our coverage reviews are provided as a professional service based on the information and documents you provide. Results are opinion-based assessments, not legal or accounting determinations. DANESURE:

• Is not liable for errors or omissions in documents provided by you or your current carrier
• Cannot guarantee the accuracy of EMR, loss run data, or other third-party information
• Makes recommendations based on industry benchmarks and available data, which may not reflect your specific risk profile in all cases
• Does not provide legal, tax, or financial advice — consult qualified professionals for those matters

6. Document Uploads

When you upload policy documents through /upload, you represent that:

• You are authorized to share the documents with a licensed insurance broker on behalf of the named insured
• The documents are genuine and have not been altered
• You understand the documents will be used solely for the purpose of preparing an insurance analysis and/or quote

We maintain appropriate security measures for uploaded documents as described in our Privacy Policy. We accept no liability for documents transmitted over the internet prior to reaching our servers.

7. Website Use

You agree to use danesure.com only for lawful purposes and in a manner that does not infringe upon the rights of others. You agree not to:

• Submit false, misleading, or fraudulent information in any form
• Attempt to gain unauthorized access to any part of our website or systems
• Use automated tools (bots, scrapers) to access or collect data from our website without permission
• Transmit any malicious code, spam, or harmful content
• Impersonate any person, business, or licensed professional

DANESURE reserves the right to refuse service, remove submissions, or take appropriate legal action for violations of these terms.

8. Intellectual Property

All content on danesure.com — including text, graphics, logos, data compilations, and software — is the property of DANESURE, Inc. or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Limitation of Liability

To the fullest extent permitted by applicable law, DANESURE, its officers, employees, agents, and licensors shall not be liable for:

• Any indirect, incidental, consequential, special, or punitive damages arising from your use of our website or services
• Loss of coverage, claims denials, or underinsurance resulting from information you provided that was inaccurate, incomplete, or outdated
• Actions or decisions made by insurance carriers, including coverage denials, policy cancellations, or rate changes
• Technical interruptions, errors, or unavailability of our website or services
• Unauthorized access to your information resulting from circumstances beyond our reasonable control

In no event shall DANESURE’s total liability to you exceed the total brokerage fees or commissions received from your account in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold DANESURE, its officers, employees, and agents harmless from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of our website or services, (b) your violation of these Terms, (c) any information you submitted that was false, misleading, or unauthorized, or (d) your violation of any applicable law or third-party rights.

11. Third-Party Services

Our website and services integrate with third-party providers including Google Analytics, Google Workspace (email & calendar), Microsoft 365, Resend (email), VAPI (phone AI), and Cloudflare (hosting). Use of these services is subject to their respective terms and privacy policies. DANESURE is not responsible for the practices or content of third-party services.

12. Regulatory Compliance

DANESURE operates under the jurisdiction of the Arizona Department of Insurance and Financial Institutions (DIFI). If you have a complaint about our services that cannot be resolved directly with us, you may contact DIFI at (602) 364-2499 or difi.az.gov.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.

Before initiating any legal proceeding, you agree to contact us at support@danesure.com and give us 30 days to resolve the dispute in good faith.

14. Changes to These Terms

We may update these Terms at any time. We will post the revised Terms on this page with an updated effective date. For material changes, we will notify active clients via email. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.

15. Termination

Either party may terminate a brokerage relationship at any time with written notice. DANESURE reserves the right to discontinue services to any client or visitor who violates these Terms or whose business we determine we cannot appropriately service. Termination does not affect any obligations arising prior to the termination date.
